1) minors;
2) workers engaged in work with harmful working conditions;
3) certain categories of workers (teachers, doctors, etc.).
For harmful working conditions on such works the working week is set, which does not exceed 36 hours.
The very list of manufactures, workshops, professions and positions with harmful working conditions, the work of which gives the right to a shorter working week, approved by the resolution of the Cabinet of Ministers of Ukraine of 21.02.2001 № 163.
The shortened working time, according to the List, is provided for an employee only if he was engaged in harmful working conditions not less than half the length of working time.
For those workers who, according to the List, are "permanently employed" or "permanently employed" in harmful working conditions, working hours are shortened only in those days when they were involved in harmful working conditions throughout the working day.
It should be noted that the right to shortened working hours for such workers arises on the basis of assigning their jobs to a category with harmful working conditions. This assignment is carried out on the results of the certification of workplaces under the terms of work (in accordance with the Procedure for conducting attestation of workplaces under labor conditions, approved by the resolution of the Cabinet of Ministers of Ukraine from 01.08.1992, No. 442).
