Early termination of the lease agreement: VIDEO

Grounds for early termination of the land lease agreement are specified in the Law of Ukraine "On Land Lease".

In this case, it is necessary to take into account the terms of lease of land plots provided by the legislation. In particular, the maximum term of lease of non-agricultural land is 50 years. Agricultural areas are provided for a lease for a minimum of 7 years.

There are two ways to break the lease agreement:

1. By agreement of the parties.

2. At the request of one of the parties in court.

If the agreement is terminated by agreement of the parties, the following algorithm of actions is foreseen:

Registration of the agreement on termination of the agreement, which contains the date of termination of the lease agreement and the obligation of one of the parties (as a rule, the lessee) to carry out state registration of the termination of the right of lease. In this case, the actual lease term for which the rent will be paid is calculated.

The next step is an appeal to a state registration entity to terminate the state registration of the right to lease.

If the agreements can not be reached, the lease agreement can be terminated by court. For this purpose it is necessary to send the corresponding claim statement to the court at the location of the plot.
