
Note, according to Art. 657, 715, 719, 729, 732, 745, and 1304 of the Civil Code of Ukraine, notarial certificates are obligatory to purchase, sale, donation, rent, life maintenance / care, inheritance and mortgage contracts. To determine the amount of taxes and fees of a notary, an independent assessment is required. At the same time, such an assessment is unnecessary in the case of obtaining a real estate by inheritance or a gift by relatives of the 1st and 2nd degree of kinship, because according to Art. 174.8 of the Tax Code of Ukraine, a zero rate applies to real estate tax.
According to the provisions of Art. 3 and 5 of the Law of Ukraine №2658-14, the independent valuation of property is carried out by the following subjects of economic activity:
- legal entities - enterprises in the field of valuation activities (at least one certified appraiser must be employed);
- individual enterpreuners with a certificate in the field of valuation activities;
-bodies of state power and local self-government, authorized to evaluate property.
Independent appraisers, as a rule, can be prompt by realtors or notaries, you can find them by yourself as well. For the property valuation procedure, you must provide the expert with the original passport, a document confirming ownership of the property, technical passport of the BTI. The report provided by the appraiser after visiting the object and processing the documentation must necessarily include the name of the object, its address, technical characteristics, the type of the determined value, and the method of its calculation, and the estimated estimated "market" value. Such a report should be made in two copies (one - to the customer, one - to the archive of the artist).
For the work of an independent appraiser in Kiev one will have to pay an average of 400-500 UAH per apartment and 700-1000 UAH per house, in the regions the cost of services is lower - from 300 UAH for the appraisal of the apartment, and from 500-600 - for the assessment of the house.
After transmitting the report to the notary, he calculates the amount of all necessary fees and taxes.
