Building developers got new construction standards

The new SBS B.2.2-12: 2018 "Planning and Building Territories" came into force on September 1, 2018. Consequently, architectural, design organizations, general contractors and building developers must now bring project documentation in line with it. This was emphasized by the Minregion.

However, let us note, even on the eve of the entry into force of the SBS B.2.2-12: 2018 "Planning and Building Territories" in the District Administrative Court of Kyiv, a number of lawsuits were filed from companies and individuals that were aimed at recognizing  illegal and invalid the corresponding order of the Ministry of Regional Development on the approval of a new SBS (from April 23, 2018, No. 100). The court issued a decision on August 27 to satisfy one of the claims for its enforcement. However, when considering another claim, the court refused to comply with the application. Therefore, the Minregion applied for the abolition of the preventive measure adopted on the suspension of the order and the petition for consideration of the case in general consideration. According to Deputy Minister of Regional Development Lev Partskhaladze, actions aimed at inhibiting the process of the entry into force of the new SBS violate the rights of those who are ready to build on new norms and those whose living conditions will not improve.

Note that the new SBS foresees a change in the appointment of adjoining territory. In particular, when designing new or reconstruction of existing residential quarters, it is proposed to increase the specific size of recreational facilities for adults in 2 times and 10 times for physical education by the business premises. Also, the SBS introduces new lines of altitude ("blue lines"), green areas (green lines), building constraints for evacuation safety ("yellow lines"), density and surface constraints, and so on.

In addition, changes are envisaged in the area of ​​combating congestion and development of public transport. Among the streets and roads, parking is restricted to sidewalks and roads, safety standards are set for roads (security islands, protective gates at public transport stops and others). There is also a mandatory arrangement in the school premises of the inclusive space, introduction of energy-efficient measures, increase of the area of ​​educational classes, etc.
