
The relevant bill No. 9063 was registered in the Verhovna Rada on September 6, 2018 under the name of the "Stop Raidership! (On Amendments to Certain Legislative Acts Concerning Protection of the Rights of Owners of Property by Audio and Video-fixing of the process of carrying out notarial acts).
According to the explanatory note , audio and video fixation is provided at the time of commissioning by a notary acts on land, corporate rights and / or real estate, in particular, the following transactions:
- alienation of the shareholder of a share in the authorized capital;
- alienation of shares owned by the shareholder of PAO;
- a contract of sale of land, a single property complex, a residential building (apartment) or other immovable property;
- executive inscriptions on documents establishing debts;
- securities purchase and sale agreement;
- power of attorney (if the agreement for which it is issued is subject to a notarial certificate);
- contracts for lease of a land plot, concluded with a person (except when the landlord acts as an individual enterpreuner).
In accordance with the bill the responsibility of the notary for the implementation of such operations without fixing the process is provided in the form of loss of a certificate of the right to conduct notarial activity.
Sound and video materials should be put by the project authors to the State Register of Rights. In case of non-delivery, administrative liability is provided in the form of a fine in the amount of 400-500 untaxed minimum of citizen income (6800-8500 UAH). For forging the materials, the project established liability in the form of a fine of up to 17 thousand UAH, or arrest for a term up to 6 months, or restraint of liberty for a term up to 2 years.
In the opinion of the initiators of the project, such changes should protect the property rights of owners from unlawful seizure through the actions of notaries in collusion with raiders.
