Late employee renewal at work: what are the consequences?

The decision to reinstate an employee unlawfully dismissed or transferred to another job, made by the body that is considering the labor dispute, is subject to immediate enforcement.

In the event of delay by the owner or his / her authorized body of the execution of the decision of the body which considered the labor dispute about the resumption of illegally dismissed or transferred to another job, that body shall make a decision on payment of the average salary or the difference in earnings during the delay.

The decision of the body that considered the labor dispute about the resumption of the work of an illegally dismissed or transferred employee shall be considered enforced when the owner, or his authorized body, has issued an order, work permit and is actually admitted to the work of such employee.

In the event of late renewal of an employee at work due to the fault of the owner or the body authorized by him, the average salary shall be paid to him for a clearly defined period of time: from the date of making the relevant decision by the body, which considered the labor dispute, until the day of its actual execution.
