Extended procedural terms during quarantine will end in 20 days

Today, on July 17, the Law № 731-IX on the expiration of procedural terms during quarantine comes into force.

The new law amends the final provisions of the Code of Civil Procedure, the Code of Civil Procedure, the Criminal Procedure Code, according to which during the quarantine the procedural terms are restored by the court if it recognizes the reasons for the omission:

  • respectable,
  • due to restrictions imposed in connection with quarantine.

The application for renewal of the term may be submitted by:

  • participants in the case,
  • persons who did not participate in the case, if the court has decided on their rights, interests and responsibilities (if they have the right to take appropriate procedural actions).

The procedural terms, which were extended by law № 540-IX, expire on August 6.

Thus, the new Law № 731-IX stipulates that the procedural terms, which were extended in accordance with Law № 540-IX, expire 20 days after the entry into force of Law № 731-IX. During this 20-day period, the participants in the case and persons who did not participate in the case, if the court has decided on their rights and interests, have the right to extend the procedural terms on the grounds already established by this law № 731-IX.

It will be recalled that the relevant Law № 731-IX was adopted on June 18 (draft № 3383).
