Evacuation of a vehicle will be possible only if the placement of the vehicle significantly impedes traffic or poses a threat to traffic safety (in particular, in places marked with corresponding traffic signs, with two-row parking, etc.). Or if the vehicle is located in places intended for stopping, parking, free parking of vehicles operated by drivers with disabilities or drivers carrying persons with disabilities.

In other cases, temporary detention will be carried out by blocking a car with the help of technical devices.

In addition, they will temporarily detain the car in the event of detecting a vehicle of the debtor declared to be wanted in accordance with Article 36 of the Law of Ukraine "On Enforcement Proceedings".

Please note, in the case of a temporary arrest of a vehicle, an inspection act must take place. The location of such a vehicle must necessarily be recorded in the mode of photographing (video recording), except for cases of temporary arrest of the vehicle of the debtor declared in search.

When photographing, it is mandatory to have at least two images of a vehicle obtained from different or opposite sides. The image or video, along with other information about the admin violations, shall be entered into the Register of Administrative Traffic Enforcement Offenses immediately, but not later than within the next business day from the day the responsible person is established.

If the driver-offender was present at the time of temporary detention and the violation can not be removed on the spot, the police officer shall draw up a record in which the relevant record of the vehicle's detainment is made with the information on the drawing up of the inspection report and the detention.

If the offense can be eliminated by the driver as soon as possible, the police officer shall not hold a temporary detention and draw up a record of an administrative offense.

At the same time, the act of inspection and temporary detention, if it has already been made, shall be added to the report of the police officer about the fact of the driver's appearance at the site of the offense at the time of execution of work on the loading of the vehicle.

In the absence of a driver, the police officer leaves a notice of the vehicle's temporary detention on the spot where the vehicle was or under the wipers of the locked vehicle and the need for such a driver to arrive at the territorial police authority of the National Police to process the report or make a ruling.

Also, information about such detention is immediately transmitted to the mobile number and to the email address of the responsible person, entered into the Unified State Register of Vehicles. The information indicated must contain information about the address of the site, on which the person can familiarize himself with the image or video of the vehicle at the time of the administrative offense, as well as the place of its storage.

The unlocking of a vehicle is carried out by a policeman after a protocol on an administrative offense has been drawn up or a ruling on an administrative offense has been made.

A policeman informs the driver about the place of storage of a vehicle temporarily detained while drawing up the record, and in the absence thereof - to the next part of the territorial office of the National Police.

The owner will be able to return his vehicle after payment of the cost of transportation and storage of the vehicle in the amount established by a joint order of the Ministry of Internal Affairs and the Ministry of Economic Development and Development, and in case of a decision to impose a penalty in the form of a fine - its payment.

We remind that since September 27 in Ukraine, new parking rules have come into force. However, their full implementation was not possible due to the lack of legislative regulation of photo and video footage violations of the traffic rules. The certification of street video fixation plans is scheduled to be completed by April this year. By this moment, the procedure for evacuation / blocking of improperly parked cars will be done in the test (explanatory) mode.
