Financial penalties for violation of cash circulation norms are canceled

President of Ukraine Volodymyr Zelensky signed two important decrees on June 20, which canceled more than a hundred decrees issued for 1994-2014. Namely:

1. The Decree of the President dated 20.06.2019 No.419 / 2019 canceled 106 decrees issued within the limits of 1994-2014. Certain rules (articles or items) in 23 decrees were also canceled.

2. The Decree of the President dated 20.06.2019, number 418/2019 declared invalid  53 Decrees of the President, issued from 1994 to 2001 (and in 8 Decrees certain provisions were canceled).

In particular, among them - the Decree of the President of Ukraine dated June 12, 1995, No. 436 "On the application of penalties for violation of norms on the regulation of cash flow."

It should be noted that the document provided the following fines:

- exceeding the established limits of the cash balance at the cashier's office - a 2-fold amount of the amount of detected excess cash for each day;

- for non-publishing (incomplete and / or untimely) posting in cash desks - a 5-fold amount of non-profitable amount;

- for the use of cash from proceeds from the sale of products (works, services) and other cash receipts (except for funds received from cash agencies of banks) for payments related to payment of labor (except for urgent urgent) circumstances - social benefits to citizens burial, childbirth assistance, single and large mothers, for treatment in case of illness, compensations for people who suffered as a result of the Chernobyl disaster), in the presence of tax arrears - in the amount of payments made;

- for exceeding the established terms of use of cash issued, as well as for issuing cash under the report without full reporting on previously issued funds - in the amount of 25 percent of the amounts issued under the report;

- for conducting cash payments without payment by the recipient of the payment document (cash or cash receipt, receipt for a pay-as-you-go order, other written document), which would confirm payment by the buyer of cash, - in the amount of paid-up funds;

- for use of cash received in the institution of the bank not for the intended purpose - in the amount of spent cash;

- for the failure of the banks' institutions to establish limits on the balance of cash in the cashier's office, a 50-fold non-taxable minimum income of citizens for each such non-establishment.

We remind that recently the European Business Association turned to the President with the request to cancel this order. In their opinion, this decree only helped tax collectors cling to companies and apply excessive fines for rubles and corrections in the document circulation.

After the entry into force of the Decree No 418/2019, the financial fines imposed by Decree No. 436 will no longer be applied. Only the administrator's responsibility installed by the CuAO remains.

Decrees No 418/2019 and No 419/2019 will come into force on the day following the day of its publication. As of 21.06.2019 they were not officially published.
