As it is stated in the explanatory note to the document, the bill provides for the elimination of major legal loopholes that pose problems for property and business owners.
According to the main provisions of the bill it provides:
- termination of the activity of accredited entities;
- introduction of mandatory notarization of agreements on the alienation of corporate rights;
- implementation of the principle of simultaneous notarial acts and state registration of rights;
- increasing responsibility for the violation of the relevant registration procedures.
In particular, fines for violation of the law on state registration of legal entities, natural persons - entrepreneurs and public formations by officials are increasing: from 400 to 600 tax-free minimum incomes of citizens (earlier from 200 to 400).
Penalties for violation of the state registration procedure for real property rights and their encumbrances have also been increased - from 400 to 600 tax-free minimum incomes (previously from 200 to 400).
We remind, that the bill No. 1056-1 is submitted as an alternative to the bill No. 1056. There are some differences between the documents, in particular, the new draft No. 1056-1 provides:
- restrictions on the simultaneous execution of a notarial act and state registration of rights (in particular, when the emergence, transfer, change or termination of rights and encumbrances is carried out with a suspensive condition);
- possibility of access of the notary to the State Register of Property Rights in case of its temporary blocking or cancellation of access to the register in the mode of receiving information for the performance of notarial activity;
- the obligation on the state registrar to check the validity of the power of attorney, the authenticity of the court decision according to the Unified State Register of Court Decisions, etc.
