The right to file a complaint about a disciplinary offense of a judge is given to any person: individuals exercise such a right personally or with  the help of a lawyer, legal entities exercise it through a lawyer, government bodies and local self-government bodies - through their leaders or representatives (Part 1 of Article 107 of the Law "On the Judiciary and the Status of Judges").

In addition, according to Art. 39 of the Law "On the High Council of Justice", the HCJ opens and examines cases of violation by judges and prosecutors of the requirements regarding the incompatibility of their positions with the activity or status determined by the Constitution and legislation of Ukraine. Any person who knows such violations of the incompatibility requirements may also appeal for the opening of a case of incompatibility.

Although the law provides that any person may file a disciplinary complaint or incompatibility case, however, this can only be done in the prescribed manner - according to the relevant, approved by the HCJ samples of complaints that we publish below.
